1. Acceptance of Terms

By downloading, installing, or using the Website Change Tracker – Alert application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Youssef Boukhrais ("Developer," "we," "us," or "our"), the developer of the App.

2. Description of Service

The App is an Android application that allows you to:

• Add website URLs for monitoring
• Select specific visual elements on web pages to track for changes
• Set automated background monitoring intervals (minimum 15 minutes)
• Receive local notifications when tracked content changes

The App operates entirely on your device. No accounts are required, and no cloud services are used.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal Android device for your personal, non-commercial use.

5. Restrictions

You agree not to:

• Use the App for any illegal purpose or in violation of any local, national, or international law
• Attempt to decompile, reverse engineer, disassemble, or modify the App or any part of it
• Use the App to monitor websites in a manner that violates the terms of service of those websites
• Use the App to engage in scraping, data harvesting, or any form of automated data collection beyond personal monitoring
• Use the App to monitor content that you do not have the legal right to access or monitor
• Remove, alter, or obscure any proprietary notices, labels, or marks on the App
• Use the App for commercial monitoring services without our express written permission
• Circumvent or attempt to circumvent any technical limitations of the App
• Use automated means (bots, scripts, etc.) to interact with the App beyond its intended functionality

6. Your Responsibility

You are solely responsible for:

• The websites and elements you choose to monitor using the App
• Ensuring that your use of the App complies with applicable laws and the terms of service of monitored websites
• Any consequences resulting from your monitoring activities

Important: Some websites may prohibit automated access or monitoring in their Terms of Service. It is your responsibility to review and comply with the terms of any website you choose to monitor. The Developer assumes no liability for any consequences arising from your monitoring activities.

7. Intellectual Property

The App, including its design, code, graphics, and all related intellectual property, is owned by Youssef Boukhrais and is protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand features.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE
• UNINTERRUPTED OR ERROR-FREE OPERATION
• ACCURACY OR RELIABILITY OF CHANGE DETECTION
• COMPATIBILITY WITH ALL WEBSITES OR BROWSERS
• SECURITY OF DATA STORAGE

We do not warrant that the App will be free from bugs, errors, or defects, or that it will work perfectly with all websites. Website structures may change, which could affect the App's ability to detect changes accurately.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damages resulting from missed change notifications
• Damages resulting from inaccurate change detection
• Damages resulting from website terms violations by the User
• Any other losses arising from the use or inability to use the App

The Developer's total liability for any claims related to the App shall not exceed the amount you paid for the App (which is $0, as the App is free).

10. No Data Collection

The App does not collect, store, or transmit any personal data. As such:

• We have no access to your tracked websites or monitoring data
• We cannot assist with data recovery if you uninstall the App
• We cannot see or respond to data-related requests (GDPR data access, deletion, etc.) because we hold no data
• All data management is your sole responsibility

11. Third-Party Websites

The App loads third-party websites for the purpose of element selection and monitoring. Your interactions with these websites are governed by their own terms of service and privacy policies. We do not control and are not responsible for the content, policies, or practices of any third-party websites.

12. Updates and Modifications

We may release updates to the App from time to time. Updates may include new features, bug fixes, or changes to functionality. We reserve the right to modify, suspend, or discontinue the App at any time without prior notice or liability.

13. Termination

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies in your possession.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Morocco.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
